In the US, around 900 cyclists are killed in traffic accidents every year.
Although there are millions of bike enthusiasts in America, bicycle accidents can happen to even the most experienced cyclists.
If you have recently been hit by a car, here is what to do. Let’s get started:
1. Call the Police, Don’t Talk to Anyone
Before you begin shouting at the car owner or apologizing to the person who you believe caused harm, call the police.
Although this goes against human nature, it’s important that you follow these instructions as the driver’s insurance company is likely to investigate.
When the police arrive, tell them your side of the story in full, give them your name, your contact details, and your address.
Check that the police have filed an accident report and have used your words.
2. Speak to Any Witnesses
Next, try to get the contact details of any witnesses that you noticed on the scene. Ask for their name, phone number, and even their home address. If this is not possible, ask someone else to do this step for you.
Unfortunately, there is no guarantee that the police will collect this information. Even if the driver is being friendly on the scene, they may change their tune when the insurance company comes calling. You need backup and witnesses!
3. Take Pictures of Your Bicycle
If your bike is completely smashed, then it’s time to pull out your phone and take pictures of the scene.
Get as much evidence as you possibly can. Video evidence may also be useful. Take pictures and videos of the surrounding streets, interview witnesses, and record any injuries.
Of course, if you are injured, then you will need to rely on someone else to do this for you. Whatever you do, don’t forget to ask them to get a license plate number!
4. Ask for a Copy of the Accident Report
Before the police leave the scene, ask them how you can get hold of a copy of their report and whether they’ve given the driver a ticket.
This information is very useful if you decide to file a claim against the driver. Alternatively, call your local police station after the accident.
5. Hire a Lawyer That Deals With Bicycle Accidents
Find the best attorney in your local area to help you file a claim. Do not speak to anyone other than a doctor and the police about the crash until you have spoken with a lawyer.
Someone that knows this practice area well will be able to advise you on the best way to proceed.
You Have Rights After Bicycle Accidents
Although bicycle accidents are extremely unpleasant, to say the least, you should not give up. You may be able to make a claim, fix your bike, and get back on the road.
Do not attempt to go cycling until your doctor has given you the all-clear, especially if you are planning on making a claim.
